After an investigation by the North Dakota Bureau of Criminal Investigation (ND BCI), on October 30th, ND BCI swore out a probable cause affidavit, search warrants and complaints regarding allegations against Foster County Auditor Roger Schlotman and Foster County Board of Commissioners Chairman James P. Carr. 

Foster County Auditor Roger Schlotman was arrested for the following in the Foster County Case:  Three counts of misapplications of entrusted property, two Class C Felony’s and one Class B Felony.  Two counts of conspiracy to commit misapplication of entrusted property, a Class B Felony and a Class C Felony.  Two counts of tampering with public records, two Class C Felony’s.  The tampering charges relate to tampering with Foster County Board of County Commissioner meeting minutes and the misapplication of funds relate to Foster County property and/or funds.

Foster County Board of Commissioners Chairman James P. Carr was arrested for the following in the Foster County Case:  Two counts of conspiracy to commit misapplication of entrusted property, a Class B Felony and a Class C Felony.  Two counts of tampering with public records, both Class A Misdemeanors. 

After being served with the criminal complaint, Foster County Auditor Roger Schlotman offered a letter of resignation as Foster County Auditor.

On November 6th, Honorable Thomas E. Merrick, held a bail hearing for both Foster County Auditor Roger Schlotman and Foster County Board of Commissioners Chairman James P. Carr and both were released upon a personal recognizance bond.  An initial appearance is scheduled for December 4th, 2013 at 9:30a.m. in the Foster County Courthouse in Carrington.
