CITY, N.D. (NewsDakota.com) A mishap involving a pair of handcuffs that sparked a federal lawsuit against Valley City and two police officers has been settled out of court. Valley City Attorney Russ Myhre said terms of the settlement will not be made public.
In the lawsuit, Cheryl Schultz claimed she suffered permanent injuries when she was handcuffed after being arrested for DUI on March, 7 2009. One of the handcuffs got stuck and was finally taken off with an electric grinder causing second-degree burns. The complaint filed by Schultz listed police officers David Swenson, Mark McDonald and the city as defendants.
Schultz was seeking more than $50,000 in damages. But again the terms of the settlement will not be made public.
