JAMESTOWN, N.D. (KFYR) – A preliminary hearing for Kevin Hoff on Wednesday morning was delayed pending a further psychological evaluation.
27-year-old Hoff is accused of killing his ex-wife, Nicole Gututala, in May in the parking lot of her apartment building in Jamestown. He has been charged with murder.
Hoff’s attorney, Russell Myhre, requested the continuance on the preliminary hearing because of what he calls Hoff’s lack of capacity to understand proceedings.
Stutsman County State’s Attorney Fritz Fremgen did not object to the motion and the judge granted the postponement of the hearing.
The hearing has not been rescheduled at this point. Hoff remains in the Stutsman County Jail.
