FARGO, N.D. (NDHP) – A Moorhead man is facing felony charges after he allegedly assaulted a North Dakota State Trooper.

According to the news release, on Tuesday, December 17th at approximately 4:30 pm, a North Dakota Highway Patrol trooper made contact with a vehicle in the parking lot at 2535 23rd Ave S in Fargo. The driver of the vehicle was suspected of being intoxicated and had children in the vehicle.

The driver, 44-year-old Oscar Lee Jr of Moorhead, MN, was arrested for driving under the influence (DUI). While placing Lee under arrest, he resisted and began kicking at officers, striking a trooper several times. Lee continued to resist arrest and threatened officers until he was placed into a NDHP patrol car.

The trooper that was kicked received minor injuries from the assault and was treated at Essentia Hospital in Fargo.

Lee was charged with felony resisting arrest, assault on a peace officer and terrorizing. He was arrested for DUI, DUI refusal, and driving under revocation, all misdemeanors. Lee was transported to the Cass County jail.
