JAMESTOWN, N.D. (KFGO) – The parents of a man who was hit and killed while bicycling near Jamestown this summer have filed a wrongful death lawsuit in federal court against the driver of the pick-up that struck their son.

In the complaint filed Monday in District Court, Jeffrey and Julie St. John accuse James Lees, a 78-year-old Jamestown man, of negligence and wrongful conduct that resulted in the death of Timothy St. John and are asking for a jury trial and damages of or exceeding $150,000 on two counts.

The crash happened midday on June 19, on State Highway 20, ten miles north of Jamestown. Timothy St. John, a 20-year-old man from North Brook, Illinois, was riding his bicycle and wearing a helmet when he was hit by a pick-up truck driven by Lees. The State Patrol said Lees failed to yield and hit St. John’s rear tire.

Lees initially left the scene but returned and found St. John, who died at the scene.
