FARGO, N.D. (KFGO) – North Dakota Attorney General Drew Wrigley has ruled that the actions of three Fargo police officers who were part of a deadly shooting in early July were justified.

28 year-old Shane Netterville of Jamestown died after he was shot in the chest by 11 year veteran officer Adam O’Brien. The three were in a stolen van that was in the garage of a south Fargo apartment building.

Wrigley says when the officers got to the scene, there was little movement in the van and they thought it may’ve been a triple homicide. They also noticed a bullet hole in the windshield of the van.

The shooting was investigated by the state bureau of criminal investigation at the request of Cass County State’s Attorney Birch Burdick. BCI is under the control of Wrigley.

Police Chief Dave Zibolski says the officer’s have been approved to return to duty early next month.
