N.D. (NewsDakota.com) – Residents of Courtenay, North Dakota will be going to the polls on Monday, October 16th for a Special Election, but according to Councilman John Bailey, it’s actually a Recall Election.

In April, Courtenay resident Shane Moran began a petition to have Councilman John Bailey removed from the City Council. Having received the amount needed to get a recall election, the date was set for October 16th. In the petition, Moran cited Councilman Bailey for “incompetence” and “conduct unbecoming of a councilman.”

Councilman Bailey believes that advertisements saying it is a special election should be calling it a recall election.

According to North Dakota Century Code 16.1-13-05, notice of all general collections must be published by the county auditor in the official county newspaper, that being the Wimbledon Newsletter. Bailey was informed by Mayor Marcia Bolingberg that his name would be included on the ballot along with that of Shane Moran, leading him to believe the election is actually a recall election.

Bailey reports that he has contacted Stutsman County Auditor Nicole Meland to halt the election for several reasons including the wrong election being advertised. Bailey read some from the e-mail he composed to County Auditor Meland.

The special election is set for Monday, October 16th at the Courtenay City Hall from 7 AM to 7 PM. Courtenay Mayor Marcia Bolingberg and Stutsman County Auditor Nicole Meland declined to comment. Shane Moran did not respond for comment.
