N.D. (NewsDakota.com) – The Jamestown Police Department has asked for the resignation of police Sergeant Thomas Nagel following an internal investigation.

The resignation follows that of Elizabeth Kapp from the Stutsman County Sheriff’s Office, which was also the result of the joint/parallel investigation by both the Jamestown Police Department and Stutsman County Sheriff’s Office. The internal investigation was requested by Police Chief Scott Edinger and Stutsman County Sheriff Chad Kaiser.

A review board comprised of four officers of different ranks and a private citizen were asked to determine if any officers of the Jamestown Police Department violated policy relative to the Whistle Blower broadcast by Valley News Live.

“The criminal investigation was to attempt to determine if there were criminal acts perpetrated by anyone involved in the incident. Once that investigation was completed it was forwarded to Cass County Assistant State’s Attorney Cherie L. Clark. Ms. Clark concluded there was insufficient evidence to support a criminal prosecution against anyone involved.” Edinger reports in a letter to the review board.

Nearly 40 people were interviewed during the internal investigation. After the internal investigation was completed and the information had been reviewed by the disciplinary review board, it was found that Sgt. Nagel had violated 19 policies. This prompted the suggestion to terminate Sgt. Nagel from the Jamestown Police Department.

“Sgt. Nagel eroded the public trust in local law enforcement to a severe degree. Combined with his impairment under Giglio, he is no longer a viable law enforcement officer. As determined by the review board, he violated numerous policies and procedures, and violated the North Dakota Peace Officer’s Code of Conduct. I must agree with the review board’s recommendation for termination.” Edinger pointed out in his letter.

Sgt. Nagel had been an officer with the department since April 1989.
