CITY (NewsDakota.com) Southeast Judicial District Judge Jay Schmitz has upheld an Administrative Law Judges annexation ruling that was being appealed by a rural Valley City couple.

City Attorney Russell Myhre said Steven and Linelle Guertin, who own a tract of land south of Valley City and north of 35th street southeast, had argued that the Administrative Law Judge had abused his discretion in allowing the annexation and that the Judge improperly viewed the property in question.

Myhre argued there was sufficient evidence for the Administrative Law Judge to allow the annexation and District Judge Schmitz supported the original decision in a Memorandum Opinion on March 20.

Valley City Mayor Bob Werkhoven said, “this decision is one more building block in the future of Valley City.”
